Location Requirements

Gas Pumps - SDM licenses will not be issued to any applicant who sells gas at an existing business, who had any interest (direct or indirect) in a business which sells gasoline at the proposed location, or at any location where gasoline is sold regardless of whether the SDM applicant has an interest in that part of the business. The Commission may consider exceptions in local units of government having a population of 3,000 or less.

Drive Through/Drive In - SDM licenses will not be issued to any applicant who operates drive-through or drive-in business. Additionally, the owner may not change the nature of the business to include a drive-in or drive-through once a license has been issued.

State and Local Codes - SDM businesses are subject to state and local codes for building, plumbing, zoning, fire, sanitation and health laws and ordinances.
